1. About EDG Projects

EDG Projects Australia is a registered building design practice based in Victoria and New South Wales, delivering full-service design and project coordination for commercial, hospitality, and high-end residential developments.

2. Services Provided

We offer:

• Pre-concept consultation
• Concept design and development
• Planning permit documentation and approvals
• Working drawings and construction documentation
• Tendering and contract negotiation
• Contract administration and project management

Additional services such as 3D renders, feasibility studies, and interior design may be available upon request.

3. Client Responsibilities

Clients agree to:

• Provide accurate and timely information
• Respond to communications, feedback requests, and approvals
• Permit site access when required
• Review deliverables and confirm progress throughout the project

4. Fees and Payment Terms

Unless otherwise stated in your agreement:

• A deposit is required before work commences
• Progress payments are invoiced at project milestones or fortnightly
• Final invoices must be paid prior to delivery of final documents
• Late payments may attract 5% monthly interest and service suspension

5. Variations and Additional Services

Changes to scope, design, or documentation after commencement will be treated as variations. These must be agreed in writing and may incur additional fees.

6. Intellectual Property

All drawings, designs, and documents remain the intellectual property of EDG Projects unless otherwise agreed in writing. They may not be used, shared, or reproduced without our prior consent.

7. Confidentiality

All personal, business, and project-related information provided by the client is confidential and will not be disclosed to third parties without permission, unless required by law.

8. Project Cancellation

Cancellation of services must be provided in writing. EDG Projects will issue a final invoice for all work completed and expenses incurred up to the date of cancellation. Deposits are non-refundable unless otherwise agreed.

9. Website Use

By using our website, you agree not to:

• Reproduce or distribute content without permission
• Attempt unauthorised access to our systems
• Upload malicious content
• Misrepresent your identity

10. Limitation of Liability

We are not liable for:

• Losses arising from third-party delays or construction errors
• Indirect or consequential damages
• Delays caused by council, regulatory approvals, or contractors

11. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of Victorian courts.

12. Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through mediation before pursuing legal action. Costs will be borne individually unless otherwise agreed.

13. Force Majeure

We are not liable for failure or delays caused by events beyond our control, including but not limited to natural disasters, pandemics, labour disputes, or supply shortages.

14. Insurance

EDG Projects holds Professional Indemnity and Public Liability insurance. Proof can be provided upon request.

15. Marketing Use

Unless the client explicitly opts out in writing, EDG Projects reserves the right to use completed project materials (e.g. photography, renders, drawings) in marketing, awards, or promotional content.

16. Updates to Terms

These Terms may be updated periodically. Updates will be published on our website. Continued use of our services implies acceptance of any changes.
